1.09: "Marine Down"

The team's at the shooting range, and Kate and Tony as usual are getting competitive. They shoot, and Gibbs comes to look at their targets. Tony hit his more times, but he blasted the victim's ear off.

GIBBS. Not bad. both of you, not bad. Of course, these targets don't shoot back.
KATE. That must be next week.
Now Gibbs is going for accuracy...he tapes Tony's cover over the victim's face. Poor Tony's groaning and kicking at the dirt. Kate presents her cap to Gibbs with a smile, but he reaches under her jacket to pull her PDA from her waist. He grins and holds it up to her. "Did you back this up?"

Kate is pissed. Never, never, make Kate mad.

KATE. If we screw this up, I have a suggestion.
TONY. What?
KATE. We break into Gibbs's basement and we set his boat on fire.
TONY. That's cold, Kate. I knew there was a reason I liked you.
...
GIBBS. Fire. Let's see how you do under pressure.
TONY. I'll bring the lighter fluid.
KATE. Deal.

Guess Tony's cap didn't make it, because Abby loves the bullet-holed cap. Tony gives it to her. He's been assigned to work on the case - a dead Marine's wife got a phone call at his wake...from her dead husband. The computer won't let him access Maj. James Kidwell's record. "That's because computers can sense fear, Tony." Turns out, though, Abby can't get in, either, because Tony's clearance turns out to be too low.

When Kate and Gibbs get back from the interview, still nothing. Kate tries...zip. Gibbs' turn.

TONY. Gibbs'll get in. He's got clearance that'll let him see the dead aliens buried in Area 51.
KATE. Because he probably killed them.
[GIBBS DOESN'T GET IN]
GIBBS. Hm. Someone is deliberately blocking us.
KATE. Or a glitch. Everything doesn't have to be a conspiracy against NCIS, guys.
GIBBS. [SMILING] Are you saying we're paranoid, Kate?
KATE. If the shoe fits....
Yep. And the shoe fits...like it does on Cinderella. But, as usual, Gibbs is right this time - Kidwell's CO calls, tells them to come by to see him. He wants to keep their deaths off record. They were supposedly poisoned because they pissed off some women at a brothel. Just as the session's ending, Abby calls about the phone tap they were going to put up on the Kidwells' phone...there was already a tap on the phone, and it goes straight to Quantico, where Kidwell's CO is.

Gibbs goes straight into the office building and demands to see the CO. Oops. He's about as African-American as you can get...whereas the guy who they were talking to before? As Caucasian as you can get. So unless he pulled a Michael Jackson.... The CO is unhappy - he's getting back his Marines in sealed caskets, and no one will answer his questions about what happened to them.

Gibbs goes to Morrow for help, and Morrow - hey, like Kate, he doesn't necessarily think there's a conspiracy behind every door - promises he'll pull some strings.

Kate and Abby and Tony are trying to reconstruct the fake colonel's face, and Kate and Tony are squabbling over the nose. Gibbs comes by and is about to send Tony to pull Leave and Earnings Statements for him while he and Kate finish the fake colonel, but Kate volunteers.

When she shows up back in Abby's lab, Gibbs and Tony seem like they're just about done...not. It's Ducky they've created. "While you were playing, I sketched our fake colonel." She holds up the pencil sketch. Abby thinks it's awesome, and Gibbs is impressed, but Tony snatches her pad from her and starts flipping through her other drawings, which she doesn't want to share. There are two caricatures (See Kate's profile for the link to her drawings), one of Tony, and one of Abby. Tony's dying to see the one she did of Gibbs, but she snatches it away.

Then Mrs. Kidwell shows up with Jim's old friend, a Major O'Donnell. Kidwell left a message on his answering machine...and when Abby cleans it up, it's a voice match. When they dig up the coffin, though, Kidwell's in it, and O'Donnell and Gibbs have to break the news to his widow. Tony, though, is still following Gibbs' lead. (Or, Gibbs' gut's lead.)

While Ducky works on the body, Gibbs gets a call from Kidwell's Marine buddy's widow, Lisa Peary, who chews him out for letting her get interrogated by an Agent DiNozzo. Only problem - Tony's standing right there in the office. It's the fake colonel, not as the fake DiNozzo. Gibbs hurries to the park where Peary and her children are, but the man has run off. Gibbs takes off after him but he gets away. CIA - he tells Kate and Tony back at he office. No one else has armor-plated economy cars.

Major Kidwell was embalmed alive - which is why Ducky can't pin down a time of death. EW! Sick! The date on the little stuffing in the cut in his neck is newspaper - and it's the date of after his funeral. Kate and Gibbs figure it out - they knew NCIS was going to dig up the body, then killed him and hoped NCIS wouldn't notice.

They're going to check to Peary's coffin...with a ground-penetrating radar. Tony loves playing with it and tests it out on one grave.

KATE. What's that by the feet?
TONY. I don't know.
GIBBS. [SHINING FLASHLIGHT ONTO TOMBSTONE...WHICH HAS AN OLD LADY'S NAME AND A DOG'S] Fluffy.
KATE. Ewww!
TONY. That must have been one lonely old lady.
GIBBS. And one pissed-off poodle.
Ha. Poor dog. Check on Peary...he is not in the grave.

Seems a CIA agent in charge of paying a $2 mil ransom for Peary and Kidwell, kidnapped by Colombian insurgents, didn't...he kept the money for himself. Morrow sends Gibbs down to Colombia to get their Marine. Sure enough, Peary is there in a funeral parlor, but alive and untouched - so far.

Canton demands to see Gibbs, who is injured after covering Kate from an exploding grenade. He's got blood sliding down his arm.... Just when Canton's not paying attention, Kate and Tony appear, firing, and take him down.

The Peary children are playing in the yard when the car pulls up. Kate opens the back door, and Peary comes out. The children are overjoyed to see him and jump all over him. Lisa Peary comes out and is trying to hold back her tears as she hugs her husband. The touching moment is accented by a brief bit of humor - one of the shots nicked Peary's ear (although he's untouched otherwise) and Kate is sure it was Tony's shot.
